1. Acceptance of Terms

By accessing or using the ArtCollection API and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.

2. Description of Service

ArtCollection provides an API service that delivers structured art market data, including auction results, artist analytics, and market intelligence. Access to the service is provided on a subscription basis according to the pricing tier selected.

3. API Usage

Your use of the API is subject to the following conditions:

• You must use valid API credentials for all requests
• You may not exceed the rate limits associated with your subscription tier
• You may not share your API credentials with third parties
• You may not attempt to circumvent usage limits or security measures
• You may not use the API for any unlawful purpose

4. Data Usage and Restrictions

Data obtained through the ArtCollection API:

• May be used for internal research and analysis purposes
• May not be resold or redistributed without written consent
• May not be used to create a competing service
• Must be attributed to ArtCollection where required by your agreement

5. Intellectual Property

The ArtCollection API, documentation, and all related materials are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service in accordance with these terms. All rights not expressly granted are reserved.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice to existing subscribers.

7. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for any service interruptions beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, ArtCollection shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your access immediately if you violate these terms. Upon termination, your right to access the API ceases immediately.

10. Modifications to Terms

We may modify these terms at any time. Material changes will be communicated via email or through the service. Continued use after changes constitutes acceptance of the modified terms.

11. Governing Law

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York County, New York.
